The event will be carried out by Swiss International Airlines (hereinafter “SWISS”).
The participant agrees to the following terms and conditions when he or she applies:
1. Application and eligibility for the event of 27 to 30 March 2020
For a valid application, the participant must complete the online form on www.swiss.com/LX71 with his or her personal details and agree to the terms and conditions of participation. Applications will be accepted from 2 December 2019 until 08 March 2020.
The number of places is limited. If a place is still available, confirmation of the application will be sent within two working days; the place may not be transferred to a third party. The date of application is the determining criterion for acceptance. However, SWISS explicitly reserves the right to apply selection criteria to its final choice that reflect its legitimate interests. These include, but are not limited to, ensuring the inclusion of a broad range of participants from a variety of firms from across Switzerland. Applicants are not entitled to participate in the event simply by virtue of having applied.
SWISS also reserves the right to set aside 10% of the places and to distribute these by lottery. If such a lottery were to be held, SWISS would announce this and the application criteria in the eXperts newsletter. An unconfirmed application will not automatically be applied to the lottery.
Participation in the event is free of charge and independent of any purchase or the provision of paid services. Only persons of legal age and capacity residing in Switzerland may participate in the event. They must be in possession of a passport valid for entry to the USA. In order to benefit from visa-free entry to the USA, the participant is solely responsible for applying for an ESTA visa waiver online. Should a visa be necessary, the participant is solely responsible for obtaining it. Multiple applications are not permitted and will not be taken into consideration. The participant confirms that his or her own contact details were used in the application.
Employees of SWISS, its affiliates and of the Lufthansa Group, as well as their family members may not participate. Trainees and interns are also excluded from participating.
2.Changes to the rules of participation and termination of the event
SSWISS reserves the right to change the rules of participation at any time. SWISS also reserves the right to postpone, cancel or interrupt the event at any time due to unforeseen circumstances, particularly if these might disrupt or prevent the normal proceedings of the event.
3. SWISS’s obligations
SWISS undertakes to pay for the cost of the flight from Zurich, Geneva and Basel and the return flight to Zurich, accommodation (double occupancy) and board as far as this is part of the official programme, as well as the costs of the peripheral programme. For participants from Lugano, air transport costs to and from Zurich will also be covered. The general conditions of carriage of SWISS or of its partners who may issue tickets shall apply. SWISS will not pay for the cost of an overnight in Zurich, Geneva or Basel, should this be necessary to participate in the event.
Any additional costs, including but not limited to the minibar, telephone fees or any incidental meal costs that participants may incur by participating in the event – but beyond the ambit of SWISS – must be borne exclusively by the participant. Alcoholic drinks and other incidental private consumption must be borne by the participant. If a participant prefers a single occupancy room, he or she must pay the difference of the cost between a double and a single room.
Details to the peripheral programme will be communicated at a later date.
4. Insurance
The participant assumes responsibility for his or her insurance coverage. We recommend participants take out an emergency protection insurance package (SOS-Schutzpacket) to cover unanticipated incidents during the trip. SWISS will assume no liability or costs for any accident or injury during the event.
5. Participation at the event
Applicants who have received a confirmation from SWISS are eligible to participate at the event. The participant must be able to attend on the date indicated by the airlines and, if unable to, will not be compensated in any way. Personal details of all passengers given on the application form must coincide with those in the passport used at the time of travel. Once the participants have been notified, personal details can no longer be changed. On 27 March 2020, participants agree to show up at the agreed time and meeting place at Zurich airport. Late arrivals risk forfeiting their participation. Participants are solely responsible for their arrival at the airport. SWISS will assign seats on the airplane. Miles cannot be accumulated.
6. Data protection
SWISS advises that the personal data collected during the application process, including email addresses, names and addresses and passport details will only be used for the event and within the terms of its contractual obligations. SWISS promises to use these data confidentially and will not provide them to third parties, except where necessary for the event to take place. SWISS reserves the right to verify the data provided by participants who, in turn, have the right at any time to review the data collected by SWISS.
Photos and films will be made during the event. By applying, the participant agrees that SWISS may freely use any photos and videos in which he or she may appear during the event in any prospective reports on the event, as well as for advertising purposes promoting the new destinations, without prior express approval and without any claims to remuneration.
7. Legal recourse / Applicable law
The airline shall not enter into any correspondence concerning the application process. Legal recourse is expressly excluded and no claim for a cash payment or exchange of any kind shall be recognized. Only Swiss law shall apply.
8. SWISS liability limitations
SWISS assumes no liability to the extent permitted by law.
9. Arbitration
SWISS shall not participate in any dispute resolution procedure of a consumer arbitration board nor is it obliged to do so.
10. Severability clause
Should any individual dispositions or conditions of these terms be or become impracticable or unfeasible, the overall effectiveness of the remaining dispositions shall not be affected by them. In place of an impracticable or unfeasible disposition, other more practicable or feasible provisions shall be applied, whose effectiveness shall most closely be aligned with the aims SWISS has set itself.
In the event of a discrepancy between the German and English versions of these terms, the German version shall prevail.
